Outline of Final Research Achievements

Japan has not sufficiently conducted the legislation review concerning police officials' authority, particularly regarding the Police Duties Execution Act. This study has clarified the underlying factors of this situation by comparing Japan with South Korea (the Act on the Performance of Duties by Police Officers) and Taiwan (the Police Power Exercise Act). Despite the fact that they have much in common socially and culturally with Japan, both of them have reviewed and developed their legislations as needed. Additionally, this study has identified the conditions and topics necessary for preparing the specific and practical legislation to meet the upcoming security challenges and the nature of public security administration in Japan.

Academic Significance and Societal Importance of the Research Achievements

治安対策の検討に当たっては欧米の制度を調査の対象とすることが多いが、我が国とは社会・文化的背景が異なり、応用が困難なものも少なくない。本研究は、日本法の近似法としての性格が極めて強いにもかかわらず、これまで比較法的視点から殆ど取り上げられてこなかった現代韓国・台湾の警察法令を我が国の法制整備の素材として分析・検証し、現実の政策課題(治安課題)に対処するための一定のモデルを示す点に学術的及び社会的な意義がある。
