| Outline of Annual Research Achievements |
第一に、昨年度までに得られた総論部分の研究成果を国際的に発信し、諸外国の専門家との意見交換を行った。特に、①Japanese Yearbook of International Law誌57巻に、科研メンバー全員が、各々総論部分の成果として執筆した英文論文４本を公刊し、②メンバーのうち3名がトロント（カナダ）で開催された国際ワークショップに参加し、グローバル化の下での法と公私二元論の問題についての報告を行い、カナダ・英国・欧州等からの参加者との討議を行った。本科研では、昨年度までの研究成果として諸外国における先行業績を踏まえつつ「正統性」と「法の多元性」の二軸から「グローバル化の下での公法私法の協働」に接近する枠組みを得ていたところであるが、国際的な発信・意見交換の結果、上記枠組みを維持しつつも、これを日本法の文脈に再定位した上での議論構築・発信が重要であることが認識されるなど、極めて有益な知見が得られた。これを踏まえて最終年度の成果とりまとめを行う予定である。
第二に、当初計画で掲げた各論分野（消費者法・社会保障のグローバル化）の検討に着手した。具体的素材を総論の枠組みの中に位置づけるべく、とりわけ理論構成について意見交換を重ね、最終年度における共著論文の公刊に向けての検討・執筆作業を開始した。
第三に、本科研の問題意識をわが国の法学界と共有するための作業の第一歩として、関連する分野（民商法）の研究者を招聘しての研究会を数回行い、意見交換を重ねた。その結果、いずれの分野でもグローバル化の下での法と政治や政策の接近・交錯など、本科研の研究課題と密接に関わる問題は意識されているものの、多様な方法論も含め、様々な議論の試みが必ずしも相互に連絡されていないことが明らかとなり、本科研の理論枠組みが今後この方面での議論の活性化に貢献できる具体的な見通しが得られた。
