Outline of Final Research Achievements |
This research examined the principle of necessity that justifies or excuses an act which harmed legitimate interests in order to protect those of oneself or others from danger, based on the history of Article 37 (Japanese Criminal Code) and the present arguments in England, America, and Germany, and concluded that it would be necessary for impunity that the act minimizes harm in the situation beyond the scope of existing legal systems’ assumption and under the psychological pressure.
