Outline of Final Research Achievements |
In regard to “environmental public interest litigation” which is one of the ways of public participation for environmental protection, UK courts have for many years been open to such applications and they have interpreted the requirement of “sufficient interest” liberally. Ministry of Justice proposed to introduce stricter test of standing in September 2013, and NGOs, lawyers and judges expressed severe dissenting views to the Government proposal. Finally, the Government abandoned to introduce stricter test. Thus UK courts will easily accept “environmental public interest litigation” not only by the organizations but by the individuals.
