Outline of Final Research Achievements |
Japan adopted modern civil procedure from Germany (Meiji Civil Procedure Code (1891)), which has been believed to be “literal translation” of German Civil Procedure Code (1879). However, Japan has had so much difficulty in understanding German legal practice and its backgrounds. In this research I tried to make clear real situation of civil procedure under Meiji Code (1891-1929), how legal practitioners felt about it and its backgrounds, using as sources legal periodical Horitsu Shimbun and practical manuals for attorneys and laymen. I took up especially judge’s directive powers for fixing issues and proof-taking, especially exercised orally.

Academic Significance and Societal Importance of the Research Achievements |
明治20年代に近代法の受容が一応完了して以降の民事訴訟について、先行研究はごく少なく、表層的な理解にとどまる部分が大半を占めてきた。本研究により、裁判官と当事者の役割分担、そして口頭審理という民事訴訟手続の根本的なテーマを軸として、当時の民事訴訟の実態につき全体的な見取り図を描き出すことができた。民事訴訟の審理過程に関するテクニカルなファクターや「日本的法意識」など、通時的に妥当しうる論点を多数摘出することができ、現代日本の民事訴訟のあり方を考えるうえでも有益な成果と考えられる。
