| Outline of Research at the Start |
本研究は、役務提供者（労働者・非労働者）が共同して需要者（使用者、発注者、プラットフォーム等）に交渉を求め、需要者と一定の集団的合意に至る過程で（あるいはその結果として）市場での競争を制限することが、競争法上、どのような場合に許される（べき）かを検討しようとするものである。競争法と集団的労働関係法の双方の観点から、EU法および米国法における状況を調査し、比較法的検討を行う。これによって、役務提供者保護の選択肢の多様性を踏まえつつ、競争法上の評価と集団的労働関係法上の評価との関係を具体的に明らかにすることを試みる。

| Outline of Final Research Achievements |
This study examines the method of adapting the application of competition law to conduct in industrial relations. There are two methods: one is to exclude the application of competition law itself to certain areas of labor law, and the other is to make individual decisions within the framework of competition law based on the justification of the labor law. The former tends to be chosen when the competition law framework is substantively and procedurally rigid and when public and private enforcement is flourishing. In addition, the question of how competition is taken into account within labor law underlies these adaptations.

| Academic Significance and Societal Importance of the Research Achievements |
本研究では、比較法の手法により、集団的労使関係における行為に対する競争法の適用の調整手法を検討した。比較対象とした、アメリカ、EU、ドイツ、フランスにおける調整のあり方についての知見が得られた。本研究は、集団的労働関係（法）と競争（法）の関係については、日本の具体的問題状況に即して、両（法）領域を横断する視点に立って検討する必要があることを示唆するものと考えられる。
