| Outline of Annual Research Achievements |
本年度は，前年度まで分析してきた懲罰的損害賠償制度やディカップリング制度について，理論を踏まえ，アンケート調査を実施し，その調査結果を統計分析した。それにより，日本に現在は存在しないこれらの制度をめぐって，一般人が実際にどのように判断・思考するかについて検証した。その成果が森 大輔・高橋脩一・池田康弘（2017）「不法行為における損害賠償の目的に関する実証的研究―アンケート調査の統計分析」熊本法学139号や Mori Daisuke, Shuichi Takahashi, and Ikeda Yasuhiro (2017) “Compensation,Punishment, and Deterrence: Survey on the Purpose of Tort Damages in the Case of a Defective Car Accident in Japan,” Asia-Pacific Journal of Regional Science,1である。また，被保険者の弁護士費用を保険者が保険金支払によって補償する保険契約である弁護士費用保険をめぐる潜在的被害者（依頼者，被保険者），弁護士，保険者の各当事者の利得構造とインセンティヴ，および当事者間の情報の非対称性に着目した経済分析を行った。その成果が池田康弘（2017）「経済分析に基づく民事紛争への保険利用の問題と課題」保険学雑誌636号である。ダブルモラルハザード問題を含む弁護士報酬契約について経済学的に分析した成果が，Ikeda Y(2017) “Economic Evaluation of Japanese Attorney Fees,”In Naito,et al.eds.,Applied Approaches to Societal Institutions and Economics.である。
