Outline of Final Research Achievements

Vertical restraints that limit the activity of the counterparty are important regulatory targets of the Antimonopoly Act. However, it has not been clear enough how it brings anti-competitive effects. In this study, we explored the theory of harm for vertical restrains. This has been classified into two types: market closure and competition avoidance. It showed that the market foreclosure can be explained in terms of raising rival cost and competition incentive lowering strategy. Furthermore, we showed that competition avoidance can be explained in terms of collusion facilitating effect, competition avoidance commitment, and competition softening. This has provided a theoretically consistent and well defined regulatory standard of vertical restraints.

Academic Significance and Societal Importance of the Research Achievements

経済のデジタル化の進展とともに新たな取引慣行が生み出されている。それらの中には競争を歪曲するのではないかと疑われているものも多い。それらの規制をめぐって世界的に議論されているが、わが国の議論はいまだ萌芽的段階である。その理由の一端は垂直的制限の反競争効果について理論的説明がないまま規制基準を議論し、総合判断しようとしてきたことにある。本研究では垂直的制限がどのような形で競争を害するのかについての理論的枠組みを従来の規制例から析出し、これを明確化することにより、新たな取引慣行にも対応可能な規制基準を提示した。
