| Research Abstract |
ハーグ国際私法会議が2005年に採択した「管轄合意に関する条約」について、その作成経緯に遡って検討・分析し、各国の国際裁判管轄・外国判決承認執行に関するルールについての考え方の違い及び共通性を明らかにするとともに、国際商事仲裁との比較を通じて、問題点を浮き彫りにする。そして、日本における国際裁判管轄に関する新規立法に生かしていく方策を考える。
