Outline of Final Research Achievements

To obtain information about a crime in mock interrogations, (1) questions that ask for free reporting, such as “Please tell me everything” (open questions), yield more accurate information than multiple choice questions (closed questions), and (2) results from non-invasive functional brain imaging show that open questions cause more significant activation in the left inferior frontal gyrus and memory-related areas than closed questions. This scientific evidence shows that open questions can be used as an objective indicator to evaluate the appropriateness of an interrogation.

Academic Significance and Societal Importance of the Research Achievements

被疑者や目撃者に対する取調べで得られた供述の真偽が裁判で争点となることが少なくない。しかし、供述の信頼性が争点となる裁判において、取調べの適切性を判断する明確な指標が、裁判官、裁判員に示されることはない。本研究は、法学、心理学、脳神経科学の学際的研究によって、自由報告を求める質問が取調べの適切性を判断する一つの指標にできること、特にその科学的根拠について非侵襲的脳機能画像法を用いた脳活動の検討結果から明らかにしたという点において、社会的意義があると考える。
