Outline of Final Research Achievements

Japan aims to deter road death and injury by punishment of death and injury by dangerous driving and by careless driving. On the other hand, in the case of ship and air plane, pilots are punished by the crime of negligence. So we need a systematic rules for traffic offenses in the near future.

Academic Significance and Societal Importance of the Research Achievements

海上ではプレジャーボートの暴走による事故が問題となっている。空中では、空飛ぶ自動車やドローンの普及が目指されている。陸上では、自動運転車の利用が現実のものとなっている。このようなときに、今後予想される事故の予防のために、刑法では過失犯論や法人・企業処罰論の検討が必要となり、刑事政策の分野では、運転・操縦の免許の在り方や処罰の方法が問題となる。また、犯罪被害者を初めとする国民の「適正な処罰を」という要望にも応えなければならない。以上の点を検討課題とした本研究の意義は大きいと考える。
