Outline of Final Research Achievements |
This study aims to find out why and how the administrative regulations once necessary should be deregulated from public law points of view. The Japanese deregulatory model has been changed from "Administrative Findings" to "Self-Creation." The previous model used to be the main tool for finding and confirming what should be de-regulated by the administrative departments. The current model changed this decision maker into the regulated persons themselves. Therefore, this study tries to draw the line between regulation and deregulation by using "regulatory sandboxes" originated from UK Financial regulations now expanding worldwide, especially to the common law nations like Australia and Singapore (but also Switzerland, and different approach in the US), also to other technology fields (AI and Blockchain),and energy industries,as well.

Academic Significance and Societal Importance of the Research Achievements |
本研究のように、公法学(行政法学)の視点から「規制のサンドボックス」制度を素材として、自主的創意の規制緩和政策を検証する点は、国内外を問わず新しい視点である。このほか、イギリス法に対比させながら、全国的に実施される自主的創意型の規制緩和政策の在り方を実証的に取り上げる点も、国内研究の動向に照らして新しい手法である。このため、本研究を通じて、規制緩和政策をグルーバルな視点からとらえることができる一方、金融法制のみならず、AI・ブロックチェーン技術をはじめとした先端的技術に係る公法学的影響を、行政介入という視点からとらえることで、社会還元可能なより実践的研究を伴うことが可能になる点がある。
