Research Abstract

本共同研究の目的は、日本国憲法が政治・社会・法の分野においてもつ、あるいはもつべき憲法の規範力について考察することにある。日本国憲法は制定後60 年を経過し、さらに21世紀の日本の政治と社会も発展しようとしている。このような日本の政治・社会の転換期において、日本国憲法は政治や社会の現実に対してどのような規範力をもっているか、あるいは、現実の政治や社会をどのように規律すべきかを多角的に考察することは、政治・社会の基礎法としての憲法の意義を再認識し再検討するうえできわめて重要な憲法学的作業である。
