Outline of Final Research Achievements

With the aim of exploring whether it is possible to conceive of a new type of contract, the contract for the supply of digital content and digital services, and if so, what form it should take, we have conducted research focusing on EU law and the implementing laws of member states. The results of this research were not only published as articles, but also widely disseminated domestically and internationally through a mini-symposium of the Japan Society of Comparative Law, an international joint seminar with researchers in France and Belgium, and joint research with the International Consumer Policy Research Center of the Consumer Affairs Agency.

Academic Significance and Societal Importance of the Research Achievements

本研究の結果、デジタル・コンテンツ(デジタル・サービス)供給契約には、一般的な契約制度・契約理論に還元することができない特殊性を見いだすことができることが判明した。とりわけ、既に広範に利用されている、デジタル・コンテンツ(デジタル・サービス)と引き換えに消費者が個人データを提供する契約に関する法制度・法理論を、個人情報保護法制との整合性に配慮しつつ構築することが必要であることを摘示し、デジタル取引法制の１つの方向性を示すことができたと考えている。
