Outline of Final Research Achievements |
In Germany, a view has emerged in recent years that courts must regulate the content of the contract for the waiver of the legally reserved portion. This view is based on the problem that the renouncer may not be able to autonomously decide to enter into a contract for the renunciation of the legally reserved portion. According to the German argument, the ultimate question that needs to be examined is what it means to truly ensure freedom of decision in order to guarantee private autonomy. It is difficult to find a uniform standard as to when freedom of decision-making is truly infringed. However, judicial precedents in Germany are instructive.

Academic Significance and Societal Importance of the Research Achievements |
平成30年の相続法改正により遺留分減殺請求権は金銭債権化されたことに伴い、遺留分を相続開始前に放棄するという手段への関心も高まりうる。わが国において遺留分の事前放棄をするには家庭裁判所の許可が必要とされるが、その許可基準が問題となる。ドイツ法の議論状況を踏まえると、放棄契約については、代償の経済的価値の不足が直ちに反良俗性の決定的な要素となるものではない点が強調されている。この議論は、終局的には、私的自治の保障のため、真に決定の自由を確保するとはどのような意味なのか、その検討に行きつくものであり、この点に関わるドイツの裁判例等は、示唆を与え得るものである。
