Outline of Final Research Achievements |
This study examines the method of adapting the application of competition law to conduct in industrial relations. There are two methods: one is to exclude the application of competition law itself to certain areas of labor law, and the other is to make individual decisions within the framework of competition law based on the justification of the labor law. The former tends to be chosen when the competition law framework is substantively and procedurally rigid and when public and private enforcement is flourishing. In addition, the question of how competition is taken into account within labor law underlies these adaptations.

Academic Significance and Societal Importance of the Research Achievements |
本研究では、比較法の手法により、集団的労使関係における行為に対する競争法の適用の調整手法を検討した。比較対象とした、アメリカ、EU、ドイツ、フランスにおける調整のあり方についての知見が得られた。本研究は、集団的労働関係(法)と競争(法)の関係については、日本の具体的問題状況に即して、両(法)領域を横断する視点に立って検討する必要があることを示唆するものと考えられる。
