本研究では、フランス啓蒙期の政治思想史を、モンテスキュー、ルソー、ディドロにおける「立法者」問題に焦点を当てて描き出す。「立法者」問題とは、理想的な政治体の「（再）創設」という政治的行為の問題であり、三人の思想家において、その政治的行為の理想は、社会のあり方や政治体構成員の意志に基づく、自律的＝再帰的な統治の回路を創出することに置かれた。まただからこそ、「立法者」は、成功の暁には自ら消滅すべき逆説的存在とされる。この逆説が示唆するのは、政治的自律の理想の実現の困難であり、その困難こそが、ルソーの「公民宗教」問題や、ディドロの「革命の連続」としての「歴史」の概念には見てとれるのである。

| Outline of Final Research Achievements |
The outcome of this research project was published as "The Vanishing Legislator: politics and history in the French Enlightenment" (March 2023). This book shows that in Montesquieu, Rousseau and Diderot, law is a privileged circuit through which the political community recursively works on itself for the sake of self-preservation, and thatthe legislator is then positioned as a disappearing mediator within this movement of political autonomy. However, whereas Montesquieu and Diderot positioned the legislator within the de facto historical process, Rousseau, by positioning the legislator as an entity on the right to obtain the people's consent to legislation, instead fulfilled the theoretical fallacy of regarding the people who are subject to the law as sovereign.

| Academic Significance and Societal Importance of the Research Achievements |
本研究の学術的意義は、立法者論という独自の視角から、モンテスキュー、ルソー、ディドロの主要政治著作を一貫した展望の下に読解した点にある。とりわけ、前二者の関係は、あくまで現実の歴史過程のなかにあるべき政治的自律の回路の実現を見ようとするがゆえに、既存の政治的秩序を歴史主義的に肯定するモンテスキューから、その既存の政治秩序の手前で、「権利上」の政治的正統性の問いを立てることによって、既存の政治秩序を問題化するルソーへの移行として理解される。また、モンテスキュー、ルソー、ディドロのホッブズに対する関係に焦点を当てる点でも、本書は17世紀から18世紀への思想史上の転換を跡づける意義をもっている。
