研究概要

本研究は,海事法における特徴的な船舶所有者等の的責任制限制度に関して,特に手続的側面に焦点をあて,(1)船舶所有者の責任制限の実施にかかる手続に関する各国法制の多様性の調査し,(2)国際条約の国内法化あるいは国際条約に基づかない独自の国内法について比較検討を加え,(3)国際条約がどの範囲で締約国の国内法を制約しているかということを中心に,条約と国内法の関係について考察したものである.
