| Outline of Annual Research Achievements |
本研究の目的は、中国共産党と人民法院の命令的指導（領導）関係を事例として、歴史的制度論の観点から、中国共産党と国家機関の領導関係を捉えなおすことである。今年度の研究実績は、第一に①党政関係の制度化と行政訴訟法の成立過程に関する研究、②環境保護法修正過程における人民法院の政治的機能の活性化に関する研究、③法曹人材の専門職業化に関する研究に関して、研究発信を行ったことである。
研究成果発信として、より具体的には、アジア政経学会春季大会での研究報告（報告題目：1980年代における党政関係の制度化と司法監督の導入―行政訴訟法の制定過程に着目して）および、60th Annual Conference of American Association for Chinese Studiesでの研究報告（報告題目：How Does the Judicial Branch Work under Authoritarianism?: Analysis of the Revision of the Environmental Protection Law in China）を行った。さらに、国際シンポジウムを主宰し、「'Rule of Law' under the Chinese Communist Party's Leadership: The Case of Professionalization of the Judges and the CCP's Governance of the People's Court」という題目でそれぞれ報告を行った。
第二に、中央政府レベルだけでなく地方政府レベルにおける政法委員会の組織変化を計量分析することで、1980年代後半以降の人民法院の相対的な政治的地位の変動および公安部との権力関係の変化について明らかにした。
