Research Abstract

Code civilの規律対象となるsociete civileは、政治的かつ経済的な社会(一元的秩序)であったこと、Code civilは、そのようなsociete civileを規律するフランス近代法体系全体の根本法であったこと、
これに対して、日本近代の国制は、ドイツ流の国家と社会の二元的秩序と観念され、これに対応して、法秩序は、帝国憲法(公法)と明治民法(私法)との二元的秩序として存在したことの比較法史的意義が解明された。
