Outline of Final Research Achievements |
The French system for land use and building regulations according to flood risk is based on zoning that takes flood risk into account within the urban planning system, and building permits and development regulations are implemented accordingly, whereas in Japan, regulations are based on individual laws for each hazard. The advantage of the French system is that disaster risk must always be taken into account when attempting to use or build on land. In terms of operation, while the French system effectively implements building and land use regulations, the reasons for the lack of implementation in Japan, despite the existence of a system, include ambiguity of responsibility and authority in terms of implementation, as well as the lack of consensus among residents and the difficulty of intervening in private rights.

Academic Significance and Societal Importance of the Research Achievements |
日本では、土地利用・建築規制に関わる制度があるにも関わらず、水害リスクの軽減においてはそれらが機能しないということが長らく問題になってきた。本研究は、フランスの同制度と比較分析を行うことで、わが国の制度と運用における問題を明らかにすることが出来た。また、わが国の水害リスクを考慮した実効的な土地利用・建築規制の制度と運用を実現するための課題を分析することで、都市地域における水害リスクの軽減のために行うべき法改正や施策の方向性を示すことが出来た。
